Crime Victims List Includes Case Where No Murder Charge Has Been Filed
Why This Matters for NY-23
Langworthy has repeatedly tied immigration policy to violent crime in social media posts and official statements. When victims are named publicly, the accuracy of the underlying facts matters — both for factual integrity and for the families involved. This post named seven women, but at least one inclusion is not supported by the legal or forensic record.
The Statement
Source: Facebook post, April 10, 2026
“Megan Bos / Sheridan Gorman / Laken Riley / Rachel Morin / Jocelyn Nungaray / Mollie Tibbetts / Kayla Hamilton
and the list goes on….
all young women whose lives were stolen by illegals who had no business being in our country. THEY are who we are fighting for & every other American citizen who deserves safety.”
The post was accompanied by Fox News footage of an ICE news conference at which families of crime victims spoke.
Case-by-Case Review
Sheridan Gorman — CONFIRMED
Gorman, 18, a Loyola University Chicago freshman from New York, was shot and killed on March 19, 2026 — less than three weeks before this post. Jose Medina, charged with first-degree murder, was confirmed by DHS to be a Venezuelan national who entered the U.S. illegally in May 2023 and was released by CBP, then again after a subsequent shoplifting arrest in Chicago.
Laken Riley — CONFIRMED
Killed in February 2024. José Antonio Ibarra, a Venezuelan national who entered the U.S. illegally in September 2022 via El Paso and was released by federal authorities, was convicted of her murder.
Rachel Morin — CONFIRMED
Killed in August 2023 in Maryland. Victor Antonio Martinez-Hernandez, who crossed the border illegally while fleeing a murder warrant in El Salvador, was convicted of her rape and murder on April 14, 2026 — four days after this post.
Jocelyn Nungaray — CONFIRMED (trial pending)
A 12-year-old Houston girl allegedly killed in June 2024 by two Venezuelan men who crossed the border illegally and were released by Border Patrol. Capital murder charges are pending; trial had not concluded as of this writing.
Mollie Tibbetts — CONFIRMED
Killed in July 2018 in Iowa. Cristhian Bahena Rivera, confirmed by USCIS and ICE to have been in the U.S. illegally, was convicted of her first-degree murder.
Kayla Hamilton — CONFIRMED (with nuance)
Killed in 2022 in Maryland by Walter Martinez. Martinez entered the U.S. as an unaccompanied minor through official CBP processing in March 2022 — not by evading the border — though he had no lawful immigration status at the time of the crime. The “no business being in our country” framing does not distinguish between different immigration pathways.
The Problem: Megan Bos
Verdict: MISLEADING
Megan Bos, 37, of Antioch, Illinois, disappeared in February 2025 and was found dead on the property of Luis Mendoza-Gonzalez, an undocumented Mexican national, in April 2025. Her case has been widely publicized by ICE and DHS. However:
- The Lake County Coroner ruled her cause of death as undetermined. Toxicology found fentanyl, cocaine metabolites, and morphine in her system. The coroner stated it was not possible to distinguish between accidental drug intoxication and asphyxiation based on available evidence.
- Mendoza-Gonzalez was not charged with murder. He faces charges of abuse of a corpse, two counts of concealment of a death, and obstruction of justice — Class 4 felonies.
No homicide charge has been filed. The cause of death is officially undetermined. Describing Bos’s life as “stolen” by an undocumented immigrant goes beyond what the criminal charges or forensic findings establish.
DHS and ICE have publicly characterized Bos as a murder victim. That characterization is a political framing, not a legal one.
Context
The post presents all seven women as equivalent and interchangeable examples of the same pattern. They are not:
- Five cases involve convictions for murder by an undocumented person.
- One (Nungaray) involves pending charges.
- One (Hamilton) involves someone who entered through formal CBP processing as a minor.
- One (Bos) involves no murder charge and an officially undetermined cause of death.
Presenting a curated list of named victims as evidence of a systemic pattern is a form of statistical argument made through anecdote. Research from the Cato Institute and peer-reviewed criminology journals has consistently found that undocumented immigrants are incarcerated at lower rates than native-born U.S. citizens.
